Decommissioning Plan

Decommissioning plan required as a part of the conditional zoning application. Must include identification of party responsible, all costs for removal down to 36 inches below grade, and restoration. Prior to issuance of building permit, the decommissioning plan will be record by the applicant in the Register of Deeds.

Decommissioning Requirements

6 months to complete decommissioning if no electricity generated for 12 months, unless the responsible party provides substantial evidence of intent to maintain and reinstate operation.

Decommissioning Financial Assurance

Must provide bond, cash escrow, or letter of credit equal to 1.25 times estimated decommissioning cost prior to the issuance of a zoning permit.
